When going through the divorce process in Ohio or elsewhere, there are a lot of mistakes that people make that only end up hurting them in the long run. Some of these mistakes can be avoided easily, especially is one has an experienced family law attorney at his or her side. Here are some of the most common mistakes made during the divorce process.
Mistake number one: failing to be prepared. When filing for divorce, a lot of personal information needs to be gathered and ready to share with one’s attorney, the other party’s legal counsel and — if the case ends up in court — the judge. Too many people fail to gather or share all the necessary information which can slow down the overall process and even result in the rejection of certain requests.
Mistake number two: making demands that are unrealistic. It is understandable to want the most one can get out of a divorce settlement. That doesn’t mean the final settlement should be lopsided. Each spouse should be able to walk away with an equitable settlement or — if a prenuptial agreement is involved — a settlement that aligns with the terms laid out in that document, as long as it is a legally valid contract.
Finally, mistake number three: exhibiting poor behavior in court. If one’s divorce case goes before a judge because all other attempts to reach a settlement have failed, like it or not, each party will be judged on his or her court behavior. From how a person dresses, to how he or she acts and treats court personnel — it can affect one’s final settlement terms.
Getting upset about divorce and all that comes with this family law process happens and is understandable.
